On June 18, 2020, the Supreme Court ruled that the Trump Administration behaved improperly when rescinding DACA. In a 5 to 4 decision immigrants receive some relief as the Court calls the Administration’s actions arbitrary and capricious. “We concluded that the total rescission was arbitrary and capricious…The dispute before the court is not whether DHS may rescind DACA. All parties agree that it may. The dispute is instead primarily about the procedure the agency followed in doing so.” (Justice Roberts) The Court’s decision allows for the continuation of the DACA program which will now have to resume new as well as renewable DACA applications. While we rejoice and give thanks for the relief that the Court’s decision provides immigrants, we must not become mired in celebration. The Court DID NOT rule that the Administration did not have the power and right to rescind DACA, rather that the way in which it did so violated the Administrative Procedures Act (APA). It is important that we continue contact with our representatives to make lasting legislative immigration reform. On March 16, the NYC Department of Consumer and Worker Protection (DCWP) announced an emergency rule that makes price gouging illegal for any personal or household good or any service that is needed to prevent or limit the spread of or treat the new coronavirus (COVID-19). As we continue to monitor the situation, we want to provide reliable information in our continuing effort to minimize exposure and lower the loss of life. We begin to see the outcomes to disadvantaged people of color and immigrants with lower access to health services who are at a higher risk of experiencing extreme symptoms and death due to lack of medical access, higher levels of chronic conditions such as high blood pressure, asthma, and diabetes; further exposing systematic disparity among marginalize communities. Public charge concerns during COVID-19 pandemic During this uncertain time many have expressed concern regarding public charge penalizations if they have to obtain medical care due to COVID-19. It is important that our churches and communities know that anyone who needs help during the COVID-19 crisis should seek care without fear, regardless of immigration status or ability to pay. Those in the immigrant population using medical treatment or preventative healthcare services related to COVID-19 will NOT be considered under the public charge rule, even if the services are Medicaid funded. What if I only have mild symptoms? If you are mildly sick, stay home as much as possible. If your symptoms do not go away or get worse after three to four days, please contact your doctor for a consultation by phone, text message, email, telemedicine (video conferencing), or through your patient portal. Reflection As believers and children of God we continue to have faith that our Holy Father will heal our world. Jeremiah 30:17 'For I will restore you to health And I will heal you of your wounds,' declares the LORD, 'Because they have called you an outcast, saying: "It is Zion; no one cares for her."' We give gratitude to our essential workers for continuing to keep us safe and receiving the things we need. Your sacrifice and dedication to the people of New York City is an inspiration to us all. Lord Jesus, we come to you to implore that you bless the workers that continue to keep us safe. We pray that you protect them and their families, medical personnel, first responders, delivery, store clerks, and so many others that continue to brave this pandemic selflessly for the good of your people, God. We pray for the scientist, that You grant them knowledge and success in their continual battle against this new virus. We pray for shelter staff and workers of other congregate care settings who selflessly serve those disadvantaged and disenfranchised. Shield them and protect them Father. In Jesus name we pray.
