![]() On June 18, 2020, the Supreme Court ruled that the Trump Administration behaved improperly when rescinding DACA. In a 5 to 4 decision immigrants receive some relief as the Court calls the Administration’s actions arbitrary and capricious. “We concluded that the total rescission was arbitrary and capricious…The dispute before the court is not whether DHS may rescind DACA. All parties agree that it may. The dispute is instead primarily about the procedure the agency followed in doing so.” (Justice Roberts) The Court’s decision allows for the continuation of the DACA program which will now have to resume new as well as renewable DACA applications. While we rejoice and give thanks for the relief that the Court’s decision provides immigrants, we must not become mired in celebration. The Court DID NOT rule that the Administration did not have the power and right to rescind DACA, rather that the way in which it did so violated the Administrative Procedures Act (APA). It is important that we continue contact with our representatives to make lasting legislative immigration reform. ![]() El 18 de junio de 2020, la Corte Suprema dictaminó que la Administración Trump se comportó incorrectamente al rescindir DACA. En una decisión de 5 a 4, los inmigrantes reciben algún alivio, ya que la Corte llama a las acciones de la Administración arbitrarias y caprichosas. "Llegamos a la conclusión de que la rescisión total era arbitraria y caprichosa... La disputa ante el tribunal no es si el DHS puede rescindir DACA. Todas las partes están de acuerdo en que puede. La controversia se basa principalmente en el procedimiento que la agencia siguió para hacerlo. " (Justice Roberts) La decisión de la Corte permite la continuación del programa DACA, que ahora tendrá que reanudar nuevas aplicaciones de DACA, así como renovables. Si bien nos regocijamos y damos gracias por el alivio que la decisión de la Corte proporciona a los inmigrantes, no debemos quedar atrapados en la celebración. El Tribunal no dictaminó que la Administración no tenía la facultad y el derecho de rescindir DACA, sino que la forma en que lo hizo violaba la Ley de Procedimientos Administrativos (APA).
