On November 4, 2019 the Department of Homeland Security published a Federal Registrar Notice (FRN) extending TPS designation to Honduras, El Salvador, Haiti, Nicaragua, Sudan, and Nepal as required by the temporary injunction resulting from Ramos v Neilson and connected Litigation. The FRN announces the automatic extension of TPS related documents, Employment Authorization Document (EAD), Form I-797 Notice of Action, Arrival/Departure Record I-94. The validity of these benefits will be automatically extended to TPS beneficiaries through January 4, 2021 for Honduras, El Salvador, Haiti, Nicaragua, Sudan, and Nepal. What is Ramos v Neilson? Ramos v Neilson, before the 9th District Court, is the first suit to challenge the termination of TPS status on behalf of the American children of TPS beneficiaries. The ACLU Foundation of Southern California, with the National Day Laborer Organizing Network (NDLON) and the law firm of Sidley Austin LLP, files a lawsuit on behalf of nine TPS holders and their five American children of TPS holders against the Department of Homeland Security. The suit calls for the stop of the unlawful termination of TPS which will terminate status for over 300,000 people from Sudan, Nicaragua, El Salvador, and Haiti, and protect tens of thousands of American children whose parents will have to return to these countries under this administration’s policies. Ramos contra Neilson, ante el9o Tribunal de Distrito, es la primera demanda para impugnar la terminación del estatus de TPS en nombre de los hijos estadounidenses de los beneficiarios del TPS.
