Rule on Asylum Ban Upheld by Court

10/3/2019

The U.S. Supreme court upheld the Administration’s July 2019 Rule temporarily banning many people from being able to seek asylum at the U.S./Mexico Southern border. The Rule will apply to those who entered on July 16, 2019, the date it was published in the Federal Registrar, or after. The Rule would require applicants at the southern border, must’ve applied for the relief in one of the other countries they traveled through. If the person has not done so, they would be inadmissible into the United States and subject to expedited removal. While many of the migrants arriving at the southern border are from the Central American countries of El Salvador, Guatemala, and Honduras, the rule will also affect many Cuban, Venezuelan, and African Countries that arrive at many countries before arriving at our border. Currently there are roughly 42,000 people seeking refuge that have been sent back to Mexico to wait for
the courts to hear their case under a new policy called “Migrant Protection Protocols”. This policy has been said to have caused a surge in cases in courts and caused disarray of cases. While the Court’s decision is temporary, while cases in California and DC are heard and decided, would place vulnerable people in jeopardy of returning to dangerous and persecutory countries or, remain in countries whose refugee system is not capable to process the influx of refugees. We encourage people to seek reputable legal counsel when addressing their legal immigration matters. If you are in need of Consultation for asylum matters in the U.S. you may contact ACTION NYC by calling 311.

Call to Action
We encourage you to contact your representative and tell them how you feel about the Administration’s new rule on Asylum by visiting https://www.house.gov/representatives/find-your-representative . You
may find your representative by entering your zip code.

Suggested Message
I stand opposed to the Asylum Eligibility and Procedural Protocol as it continues to exacerbate the humanitarian crisis at our southern border, places vulnerable women and children in danger, and goes against multilateral treaties of the United Nations.
